Welcome to Tails n’ Trails Photography (“we,” “us,” “our”). By accessing or using our website, services, or booking a photography session through www.tailsntrailsphotography.ca, you agree to be bound by the following Terms and Conditions. Please read them carefully.
1. Services
Tails n’ Trails Photography provides professional photography services, with a focus on pet, wildlife, outdoor, and lifestyle photography. Specific services, packages, pricing, and deliverables are outlined on our website or in written communication at the time of booking.
We reserve the right to modify or discontinue services at any time without prior notice.
2. Bookings and Payments
2.1 Booking Confirmation
A booking is considered confirmed only after:
- A completed booking request or agreement, and
- Receipt of a $25.00 non-refundable deposit, unless otherwise agreed in writing.
2.2 Fees and Pricing
- Session fees are flat-rate and will be agreed upon prior to the session.
- Prices are listed in Canadian dollars (CAD) unless otherwise stated.
- Physical products, prints, albums, or professionally formatted media are billed separately unless explicitly included.
2.3 Payment Terms
- The remaining balance is due within 10 days after the photography session.
- Acceptable payment methods include cash, and card.
2.4 Late Payments
If payment is not received within the stated payment terms, a late fee of $25.00 may be applied.
3. Cancellations and Rescheduling
3.1 Client Cancellations
- All cancellations must be made in writing.
- The $50.00 deposit is non-refundable.
- Changes or cancellations made less than 3 days prior to the scheduled session may result in an additional $50.00 fee.
3.2 Rescheduling
One reschedule may be permitted without penalty when requested at least 3 days in advance and subject to availability.
3.3 Photographer Cancellations
If we must cancel due to illness, emergency, force majeure, or circumstances beyond our control, all payments made will be fully refunded. No further liability shall apply.
4. Weather and Outdoor Sessions
Many sessions are weather-dependent. If conditions are unsafe or unsuitable (e.g., extreme cold, heat, storms, or wildlife risks), we reserve the right to reschedule in the interest of safety and image quality.
5. Client Responsibilities and Pet Safety
Clients agree to:
- Ensure pets are healthy, appropriately restrained, and safe to photograph.
- Disclose any behavioural issues such as aggression, anxiety, or reactivity.
- Maintain control of pets at all times unless otherwise directed.
The client assumes all responsibility for their pet(s) during the session. Tails n’ Trails Photography is not liable for injuries, damages, or incidents involving pets, wildlife, clients, or third parties.
Clients may be held financially responsible for damage or loss to photography equipment caused by the client, their guests, or their pet(s).
6. Creative Style and Editing
By booking our services, you acknowledge that:
- You are familiar with and accept our photographic style.
- Editing, retouching, and colour grading are at the photographer’s discretion.
- Requests for additional edits beyond the agreed scope may incur extra fees.
RAW images are not provided.
7. Image Delivery and Turnaround
- Turnaround times are estimates and not guaranteed.
- Images will be delivered digitally via an online gallery or other agreed method.
- Clients are responsible for downloading and backing up delivered files.
8. Copyright, Ownership, and Usage Rights
8.1 Copyright
All photographs remain the exclusive intellectual property of Tails n’ Trails Photography under the Copyright Act (Canada). The photographer retains non-exclusive, irrevocable, perpetual, and international rights to use, publish, reproduce, crop, modify, and distribute images in any media now known or later developed.
8.2 Client License
Clients are granted a non-transferable, non-exclusive license for personal, non-commercial use only, including personal printing and social media sharing.
8.3 Restrictions
Clients may not alter, apply heavy filters, crop watermarks, sell, or commercially distribute images without prior written consent.
8.4 Watermarks and Previews
Watermarked or preview images are for viewing only and may not be used or distributed. Watermarks will be removed once full payment has been received.
8.5 Photographer Promotional Use
Unless the client opts out in writing prior to the session, Tails n’ Trails Photography may use images for portfolio, website, social media, and promotional purposes. Clients may withdraw consent at any time by written request.
9. Social Media and Credit
When sharing images online, clients are encouraged to credit @tailsntrailsphotography or link to www.tailsntrailsphotography.ca. Altering images (heavy filters, cropping out watermarks, or excessive edits) is not permitted without written consent.
10. Limitation of Liability and Indemnification
To the fullest extent permitted by law:
- Tails n’ Trails Photography is not liable for indirect, incidental, or consequential damages.
- Liability is limited to the total amount paid for the session.
Clients agree to indemnify and hold harmless Tails n’ Trails Photography, including subcontractors, from any claims, damages, losses, or legal fees arising from:
- Client or pet actions
- Third-party claims related to the session
- Breach of these Terms and Conditions
This does not apply where damages are caused by proven negligence of the Photographer.
11. Indemnification
Clients agree to indemnify and hold harmless Tails n’ Trails Photography from any claims, damages, or liabilities arising from:
- Client or pet actions
- Breach of these Terms and Conditions
- Use of images beyond the granted license
12. Privacy
We respect your privacy. Personal information collected is used solely for communication, booking, and service delivery purposes. We do not sell or share personal data except as required by law.
13. Governing Law
These Terms and Conditions are governed by the federal laws of Canada and the laws of the Province in which the photography session takes place.
14. Changes to Terms
We reserve the right to update or modify these Terms and Conditions at any time. Continued use of our services constitutes acceptance of the revised terms.
